This document sets out the Bushell Interiors Terms & Conditions of sale relating to the purchase of goods from the Bushell Interiors website.
These terms and conditions are applicable every time you access our website and/or order goods from our website.
These terms and conditions apply to all goods ordered online from the Bushell Interiors website, via the internet.
Before proceeding with an order, you will be required to show that you have read and understood the following terms and conditions. We recommend that you print a copy of these Terms and Conditions for your future reference.
Your use of the website is subject to these terms.
By engaging in the action of making a purchase from this website you are accepting and agreeing to be bound by the Terms and Conditions set out herein. By using this website, you agree to be bound by the Terms and Conditions set out below. If you do not agree to these Terms and Conditions in their entirety, you must immediately stop using this website.

- “Website Terms” means the Terms and Conditions of sale set out in Section A.
- Where reference is made using “We”, “Us” in the Website terms, this relates to Bushell Interiors, a Limited Company duly incorporated under the laws of Ireland, having registered number 251586 and it’s registered office at 12, Heaney Avenue, Park West, Dublin 12. Bushell Interiors has a registered Vat number IE 8251586H in Ireland.
A. WEBSITE TERMS & CONDITIONS OF SALE
The Website Terms set out in this Section A apply to all online purchase of goods from this Website.
1.1 This site is owned and operated by Bushell Interiors.
1.2 All rights in this website are owned by us. Any unauthorised use, copying or modification is prohibited.
2. Ordering Goods
2.1 Our display of products on our website is an invitation and not an offer to sell those goods to you.
2.2 We will take all reasonable care to ensure that all details, prices, photographic representations, and descriptions of products appearing on the website are correct at the time when the relevant information was entered onto the system. We have made every effort to display as accurately as possible the appearances, colours, textures or finishes of our products that appear on the website. What you see will depend on your monitor and computer equipment, we are therefore unable to guarantee that the product images are an accurate representation of the actual merchandise.
2.3 An offer is made when you place the order for the products. We will not have made a contract with you unless and until we accept your offer.
2.4 If you enter a correct e-mail address, shortly after placing an order, you will receive an email from Bushell Interiors to acknowledge receipt of your order, known as the “Order Acknowledgement”. You may also receive an email providing you with information updates. These emails do not constitute an order acknowledgement or order acceptance from us.
2.5 Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point the goods you have ordered are dispatched from our warehouse to be delivered to the address you have given us.
2.6 All orders are subject to acceptance by Bushell Interiors and we will confirm acceptance of your order by sending you an email confirming the product(s) have been dispatched to the address you have given us (the “Dispatch Confirmation”). The contract between us (the “Contract”) will only be formed at the place where the goods are dispatched and when we send you the Dispatch Confirmation.
2.7 Non-acceptance of your order may be due to any one or more of the following non-exhaustive reasons:
2.7.1 The product you ordered is out of stock
2.7.2 Our inability to obtain authorisation for your payment
2.7.3 We have identified a pricing or product description error
2.7.4 There is a system or procurement failure; and Failed customer validation checks.
Please refer to Subsection 3 Refusal of Order for further information in this regard.
3. Refusal of Order
3.1 Bushell Interiors reserves the right to withdraw products from this Website, remove product options and/or edit any materials or content on this Website at any time.
3.2 We will endeavour to authorise payments submitted to the website.
3.3 On occasion there may be exceptional circumstances where at our sole discretion we reserve the right to refuse to process or accept an order after we have received it, or after we have sent acknowledgement of receipt.
3.4 Bushell Interiors are not liable to you or any third party if any product or editing material/content from our Website needs to be withdrawn or in the unlikely event that we refuse to process or accept an order after we have received it, or sent you an acknowledgement of receipt.
4. Stock Availability
4.1 All orders for products are subject to availability.
4.2 Very occasionally an error may occur resulting in the goods described on our website not being the goods actually available for sale. Very occasionally there may be a delay and/or supply difficulty or a breakdown in the supply of a particular product because that product is no longer in stock.
4.3 We will contact you by email to advise if we are unable to fulfil your order or one of our customer services team will contact you by telephone to advise you accordingly.
5.1 Prices on website are in quoted in Euro and are inclusive of VAT.
5.2 We reserve the right to amend prices if for example there is a change in the rate of VAT and/or delivery charges.
5.3 We endeavour to ensure all prices on the website are accurate, however errors may occur. We will inform you as soon as possible if we discover an error in the price of products you have ordered, and you will then have the option to reconfirm order at the correct price or cancel it. If we are unable to contact you, the order will be cancelled and if payment is already received, we will organise a full refund.
5.4 All total prices for goods and delivery services at the checkout represent the total price payable by the customer for those items, regardless of the address for delivery. Where VAT (or VAT equivalent) may not be applicable as a consequence of delivery address, customers are not entitled to any discount or refund to account for the differences in tax treatment and will pay the same price for the item as a customer placing an order for delivery to the EU.
5.5 We are under no obligation to supply the product(s) to you at the incorrect (lower) price (even after we have sent you an Order Acknowledgement).
5.6 Import duties may apply specific to country of delivery – we accept no liability for this cost and the customer is totally liable for any such payments and will make said payments locally at the appropriate and relevant place of payment.
6. Information Registered in completing an order
6.2 It is your responsibility to ensure that all of the information you supply to us during the order process on our website is true, accurate, current, and complete in all respects.
7.1 Payment is made by the methods indicated on our website.
7.2 You will be charged the current price for buying goods from our website at the date you place your order.
7.3 The following is the order and payment process:

7.3.2 When you have finished your selection, your next step will be to go the checkout process, where you will enter personal details (name/address) and make a payment as follows:

7.4 Your credit/debit card payment will be made through a secure website.
7.5 We take the security of your details very seriously. We use industry standard encryption methods to deter would-be hacker. We are a certified secure site for on-line payments as certified by SSL (Secure Socket Layer) certificate for transaction security. This ensures the provision of security and safe/secure data handling.
7.6 All payments are subject to authorisation by the card issuer.
7.7 If your card issuer fails to authorise the payment to us, we will not be liable for any delay or non-delivery and may not be able to form a Contract with you or proceed with your order.
7.8 Bushell Interiors must receive full payment for the order at the time the order is processed before the product is dispatched.
7.9 The Dispatch Confirmation email will then be sent to you confirming your order has left our premises and is in transit.
8.1 Subject to availability (see Clause 4 above), we aim to fulfil your order for product(s) listed in the Order Acknowledgement within a reasonable period of time unless there are exceptional circumstances.
8.2 If for any reason we cannot meet the delivery date, you will be kept informed and offered a choice to continue with the extended delivery time or you can cancel order with a full refund. Once your order has been dispatched, we will email you the details of your order to the email address provided.
8.3 We shall be under no liability for any delay or failure to deliver the products within estimated timescales.
8.4 Orders may generally require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person to whom the order is addressed.
8.5 For the purpose of these Terms, “delivery” or “delivered” is applicable once order is signed for.
8.6 Risk of loss and damage of products passes to you on the date when the products are delivered to you.
9.1 If, for any reason you wish to cancel any order you have placed and it has not been dispatched you can contact our Customer Services Team at and we will endeavour to cancel your order prior to dispatch.
9.2 It is our policy to try to process orders immediately; however, it may not always be possible to stop an order from being dispatched. In such an event, in the first instance we ask the you refuse delivery of the product when the delivery is attempted, or if that is not possible, we are happy to accept returns on all product sold on our website providing the goods are returned in their original packaging, with tags and do not remove notices in place, in perfect condition and unused in saleable condition.
9.3 In accordance with the provisions of the EU Consumer Rights Directive 2011/83/EU if you are to enter into a contract online as a consumer and you are an EU resident, you may cancel a Contract at any time within 14 days, beginning on the day after you received the product. Under the Directive if you fail to notify us within the 14 day period, you will not have a right to cancel and return the products in order to cancel the contract. This does not affect your statutory rights and you may still be able to return products under our Refund Policy.
9.4 If you have purchased products from the website and decide to cancel your order pursuant to this Clause 9, the Directive advises that you must advise us within 14 days of receipt of the products. You can do so by sending an email to our Customer Services Team at stating that you wish to cancel your order/contract, quote your order reference number. Returns will only be accepted in accordance with our Returns Clause and exclusions apply.
9.5 You will be responsible for any cost or risk incurred in returning products.
9.6 Legally, you must take reasonable care of the products while they are in your possession.
9.7 All products will be inspected on return and you will be responsible for any diminished value of the product resulting from the handling of the goods.
10. Return and Refund Policy
10.1 Exclusions: For reasons of health and hygiene we are unable to refund or exchange mattresses once the seal has been opened/removed after delivery.
10.2 This does not affect your statutory rights relating to faulty or misdescribed goods or your right to cancel orders under the consumer protection regulations.
10.3 Subject to the above exclusions refunds may be given within 14 days from the date after product is delivered, providing the products are returned in saleable quality, which means they must be returned in their original packaging, unused, referencing relevant online dispatch note number and/or official sales order number (which you can apply for by e-mailing our Customer Service team on ). Refunds will be credited to the original tender used to process the payment.
10.4 To qualify for a refund, all products must be returned following the returns policy set out above to Bushell Interiors return address;

10.5 All returns are your responsibility until they reach us. We recommend you use a tracked postal returns service, that insures you for the value of the goods being returned and that you obtain a receipt/certification of posting which you keep for your records.
10.6 The cost of returning goods is covered by you and will not be refunded unless product returned is deemed to be faulty or incorrect item was sent.
10.7 In the unlikely event goods are being returned because they are faulty, or wrong goods sent in error, we will refund cost of postage if you e-mail or post a copy of postage receipt referencing the sales order number given. Always keep original postage receipt for your own records.

11. Faulty/Incorrect Products Received
11.1 In the unlikely event that you have received the wrong products from Bushell Interiors or that the products are faulty or damaged in any way please contact our Customer Service Team by e-mail on or call +353 (1) 6710044 Mon – Fri 9am-5.30pm.
11.2 We will record details of return and advise official sales order number to quote with goods coming back.
11.3 We will refund the postage paid if you returned the product because it was faulty or an incorrect item was sent.
12. Liability And Disclaimers
12.1 All product descriptions, information and materials posted on this Website are provided “as is” and without warranties express, implied or otherwise howsoever arising.
12.2 All products offered on our website are of satisfactory quality and reasonably fit for all of the purposes for which products of the kind are commonly supplied.
12.3 Our liability in connection with any product purchased through our Website is strictly limited to the purchase price of that product. Nothing in this Clause will affect your statutory rights as a consumer, or your Contract cancellation rights.
12.4 All risk in the products we supply to you, in particular risk of any loss or damage, shall pass to you on delivery of the products to the address you specify in your order. Ownership of the product shall not pass to you until we have received payment in full in respect of each product.
12.5 We shall not be liable for any indirect losses you may suffer, including any loss of profit, income, or anticipated savings as a result of our failure to comply with these terms or our negligence. Save that our liability in respect of any death or personal injury caused by our negligence shall not in any way be restricted.
12.6 These terms, constitute the entire terms on which we will provide products to you and cancel and supersedes all prior arrangements and representations, whether verbal or written.
12.7 No delay or failure by ourselves in exercising or enforcing any of our rights or remedies under these terms shall operate as a waiver to those rights.
12.8 If any one or more of the provisions of these terms should be held by any court to be unenforceable, such provision shall be validly restated to as nearly as possible approximate the intent of the clause and, if such clause cannot be restated for any reason, shall be severable from these terms and deleted.
12.9 You may not assign or sub-contract any of your rights or obligations under these terms to any person without our prior written consent. No third party shall be entitled to enforce any of these terms.
13. Changes to Terms and Conditions
13.1 We have the right to revise and amend these Terms from time to time and when this happens, we will post updated version of these Terms on our Website. Terms and conditions are applicable at time you order product(s) from us.
13.2 We may also notify you of the change to policies or terms before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the Terms or policies, unless you notify us to the contrary within 7 working days of receipt of products.)
14.1 This website is controlled and operated in Ireland.
14.2 All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website shall be stated in English; the terms and conditions therein will be construed and governed in accordance with Irish Law and the Irish courts shall have exclusive jurisdiction in all such matters.
14.3 Any terms and conditions concerning the usage of this website will be governed by the laws of Ireland and any dispute concerning use of this website will be determined exclusively by the Irish Courts.
15. Written Communications
15.1 Applicable laws require that some of the information and communications we send to you should be in writing.
15.2 When using our Bushell Interiors Website, for contractual purposes you accept that communication with us will be mainly electronic and you agree that e-mail can be used as a long-distance means of communication.
15.3 This condition does not affect your statutory rights.
16.1 We are the owners and operators of this website, and we retain full intellectual property rights with regard to the content herein. We are the owners of the compilation of information in this website.
16.2 We note that our rights are protected by Irish, European, and International intellectual property laws, including those for the protection of copyrights, trademarks, and database rights. Misuse of this website may incur civil liability or attract criminal sanctions.
16.3 We grant you a limited, non-exclusive and revocable licence to access our website for the purposes of (1) browsing our products (2) ordering product from us; or (3) obtaining contact information for us.
16.4 The granting of this limited licence does not extend and should not be constructed to in any way grant permission to you to employ any commercial use of our website, or to any use of our website whatsoever which is for the benefit of any commercial entity other than us.
